IPOB leader Kanu again refuses to open defence, says charges have ‘no legal basis’

Detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, again declined to open his defence in the terrorism case filed against him by the Federal Government.

The court gave him more time to consult a lawyer but warned it may close his right to defend himself if he fails to proceed at the next hearing.

Kanu, who has been representing himself since dismissing his legal team, said the seven-count charge brought against him is “not backed by any existing law.” He asked the court to take judicial notice of motions he earlier filed challenging the court’s jurisdiction and demanded his release from the custody of the Department of State Services (DSS), where he has been held since 2021.

“You cannot ask me to defend myself when the law under which I am charged no longer exists,” Kanu told the court.

The prosecution, led by Adegboyega Awomolo (SAN), opposed Kanu’s claims, accusing him of attempting to stall the trial. The government asked the court to treat Kanu’s latest filings as his final written address so the case could proceed to judgment.

Justice James Omotosho rejected the prosecution’s objection and ruled that Kanu’s documents would be considered. However, the judge reminded Kanu that he is not a lawyer and granted him more time to seek legal advice. The court warned that if he fails to open his defence on the next date, his right to do so may be forfeited.

The case was adjourned to Wednesday.

Kanu is facing accusations of leading a separatist campaign and inciting violence through his broadcasts. He maintains his innocence. Earlier, human rights activist Omoyele Sowore accused the government of orchestrating a plan to sentence the IPOB leader to death or life imprisonment.
